Homage vs replica: where the line actually sits
People use the words like they mean the same thing. They do not, and the difference is the whole reason this site exists. One is a legitimate corner of the watch world that brands like Timex and Steinhart sell openly. The other is a crime.
An homage borrows a design. A replica fakes a brand.
An homage takes the design language of a famous watch, the case shape, the dial layout, the bezel style, the proportions, and builds its own watch in that spirit. It carries the maker's own name on the dial. Pagani Design, San Martin, Steinhart and Invicta all do this in the open, with their logos on the front and their names on the caseback. Nobody is being fooled. You know it is a Pagani, the shop knows, and so does everyone who sees it on your wrist.
A replica does the opposite. It copies another company's trademarked name and logo, and tries to pass as the real thing. That is counterfeiting. It is illegal to sell and, in many places, to import. It funds nothing good, the quality is a lottery, and there is no recourse when it breaks. We do not cover it, link it, or score it, ever.
Why the distinction is legal, not just moral
Design elements like a round dive case or a 24 hour bezel are not owned by anyone. Trademarks are. A watch that echoes the look of a Submariner without printing the crown or the word on the dial is trading on design language, which is fair game and always has been. The moment it stamps someone else's trademark on it, it crosses from homage into counterfeit. That single line, trademark or no trademark, is the entire test.
Is nominative comparison allowed?
Yes. Saying a watch is "an homage to the Rolex Submariner" is describing what it references, not claiming to be it. That is normal, legal language used across the hobby and the press. What is not allowed is a product that puts the Rolex name where Rolex never did.
